introduction of guests.
The Clerk presented a communication from the Division of
Highways, submitting its annual financial report, in accordance
with chapter seventeen, article three, section one-a of the code of
West Virginia.

The Clerk presented a communication from the State Rail
Authority, submitting its annual financial report as required by
chapter twenty-nine, article eighteen, section seventeen of the code of West Virginia.

The Senate proceeded to the third order of business.
A message from The Clerk of the House of Delegates announced
that that body had refused to recede from its amendments, and
requested the appointment of a committee of conference of three
from each house on the disagreeing votes of the two houses, as to
Eng. Senate Bill No. 611, Removing location requirement for
certain higher education offices.
The message further announced the appointment of the following
conferees on the part of the House of Delegates:
Delegates Campbell, Marshall and Anderson.
On motion of Senator Chafin, the Senate agreed to the
appointment of a conference committee on the bill.

routine education of all professional educators and those school
service personnel having direct contact with students on suicide
prevention by center for professional development; providing for
state board guidelines; and providing for delivery options.

A message from The Clerk of the House of Delegates announced
the passage by that body and requested the concurrence of the
Senate in the passage of
Eng. Com. Sub. for House Bill No. 4038--A Bill to repeal §33-
17-9a of the Code of West Virginia, 1931, as amended; to amend said
code by adding thereto a new section, designated §33-12C-6a; to
amend and reenact §33-17-9b of said code; and to amend said code by
adding thereto a new article, designated §38-10E-1 and §38-10E-2,
all relating to imposing a statutory lien on fire insurance
proceeds in the event of a total loss to real property; requiring
insurance companies to notify insured and municipality or county
after determining that a claim involves a total loss to real
property; defining terms; requiring a municipality or county to
perfect the lien within thirty days of notice of a total loss
determination; providing for release of the lien upon satisfaction
of certain conditions; and authorizing the Insurance Commissioner
to declare surplus lines insurers ineligible for certain violations.

designated §5-26-1 and §5-26-2, all relating to the creation of the
Herbert Henderson Office of Minority Affairs; establishing the
powers and duties of the office; providing for an executive
director, staff and office; requiring annual reports to the
Governor and the Joint Committee on Government and Finance; and
creating a Minority Affairs Fund.

program for the placement of children four to ten years of age in

reenact §61-3C-14a of the Code of West Virginia, 1931; to amend
said code by adding thereto a new section, designated §61-3C-14c;
and to amend and reenact §61-8-16 of said code, all relating to
crimes using computers and electronic devices; creating offenses
for the unlawful transmission of obscene, anonymous, harassing and
threatening communications and data by mobile phone, personal
digital assistant or other mobile device; clarifying provisions
pertaining to the unlawful obscene, anonymous, harassing and
threatening communications by traditional voice communication by
telephone; creating the misdemeanor offense of unlawful
impersonation of another by computer or other electronic means;
creating a felony offense for certain repeat offenses using a
computer, mobile phone or other mobile device; and establishing
penalties.

section, designated §18-9A-22, relating to providing supplemental
funding for providing alternative programs for limited English
proficient students; and granting the State Board of Education
rule-making authority.

A message from The Clerk of the House of Delegates announced
the passage by that body, to take effect July 1, 2010, and
requested the concurrence of the Senate in the passage of
Eng. Com. Sub. for House Bill No. 4306--A Bill to repeal §11-
1C-5b of the Code of West Virginia, 1931, as amended; to repeal
§18-9A-2a of said code; and to amend and reenact §18-9A-2 and §18-
9A-11 of said code, all relating to public school support
computation of local share; removing provisions for using assumed
assessed values for the purpose of computation; removing provisions
for increasing counties' local share responsibility for funding
basic foundation education formula when property assessments are
not at least fifty-four percent of market value as indicated by
assessment ratio study; revising definitions; and making
legislative findings with respect to the effect of under assessed
property values on school funding and the obligations of assessors
and tax commissioner.

Eng. Com. Sub. for House Bill No. 4436--A Bill to amend and
reenact §18-2E-5 and §18-5A-6 of the Code of West Virginia, 1931,
as amended, relating to promoting student achievement; clarifying
optional usage of certain testing or assessment instruments;
publishing and making such instruments available to curriculum
teams and teacher collaborations; making exclusions from
accreditation and evaluations for failure to use or exercise of
discretion in using certain assessments, strategies and programs; adding circumstance to definition of low performing school;
providing for state system of support for low performing schools
and modifying process and time lines for improvement; requiring
schools and school systems to work collaboratively with state
system of support in certain circumstances; requiring school
curriculum teams to review certain non required tests and
assessments and providing it discretion to determine usage;
authorizing team to request waiver of state and county requirements
to use certain assessments, instructional strategies or programs;
updating waivers for instructional resources; providing for
optional adoption by schools of process for teacher collaboration
to replace or in addition to school curriculum team; and providing
for membership, mission, structure, authority and duties.

relating to authorizing political subdivisions to establish risk
pools to insure their workers' compensation risks; providing that
political subdivisions may not make application to the Insurance
Commissioner to operate a risk pool until rules promulgated to
regulate such programs have been made effective; and authorizing
the Insurance Commissioner to promulgate emergency rules.

relating to the regulation and control of elections; amending the
definition of "express advocacy" and "targeted to the relevant
electorate"; amending reporting requirements for independent

A message from The Clerk of the House of Delegates announced
the passage by that body, to take effect July 1, 2010, and
requested the concurrence of the Senate in the passage of
Eng. Com. Sub. for House Bill No. 4652--A Bill to amend the
Code of West Virginia, 1931, as amended, by adding thereto a new
section, designated §18-5-45a, relating to establishing a school
calendar committee for each county; specifying membership and
method of selecting members; minimum meetings; proposals of school
calendar options for vote of employees; requirements of proposals;
preparation and distribution of ballots and tabulation of results;
process for new options if school calendar voted by employees is
rejected by county or state board; waivers and modifications.
At the request of Senator Chafin, and by unanimous consent,
reference of the bill to a committee was dispensed with, and it was
taken up for immediate consideration, read a first time and ordered

Senate Resolution No. 46--Recognizing James Fitzpatrick,
dedicated public servant and distinguished West Virginian.
Whereas, James Fitzpatrick has been a citizen of Richwood, West Virginia, for the past 40 years; and
Whereas, James Fitzpatrick is married to his beloved wife
Joan, with whom he shares the joy of having two sons, Jaime and
Todd, and daughter Kelly, along with two grandchildren, Treston and
Tyler; and
Whereas, James Fitzpatrick has served the city of Richwood in
numerous capacities, including, as a council member and most
recently as recorder; and
Whereas, James Fitzpatrick has been an honorable business man,
church member and member of several boards which all aim to better
the lives of the citizens of Richwood and Nicholas County; and
Whereas, James Fitzpatrick has excelled in public service not
only locally, but on the state level as well, having worked with
the National Guard and most recently General Tackett, and every
Governor and First Lady since 1960; and
Whereas, James Fitzpatrick has been instrumental in securing
state funds which have improved the quality of life for the
citizens of Richwood and Nicholas County; and
Whereas, James Fitzpatrick has earned the respect of his
colleagues, the citizens he represents and all people who have
crossed his path during his many years of public service; and
Whereas, James Fitzpatrick's high degree of professional
integrity exemplifies the public's expectations for the conduct of
a public servant; therefore, be it
Resolved by the Senate:
That the Senate hereby recognizes James Fitzpatrick, dedicated
public servant and distinguished West Virginian; and, be it
Further Resolved, That the Senate commends James Fitzpatrick
for his tireless work for the people of Richwood, Nicholas County
and West Virginia; and, be it
Further Resolved, That the Clerk is hereby directed to forward
a copy of this resolution to James Fitzpatrick.

(c) In addition to any authority of the Commission to allow
special rates or contracts under any other provision of the code or
rule, and in addition to all other factors which the commission may
consider in setting rates for consumers of electric power,
including, but not limited to the Commission's responsibilities
under subsection (b), section one, article one of this chapter, and
notwithstanding any other provisions of this code to the contrary,
in setting a special rate the commission may take into
consideration fluctuations in market prices for the goods or
products produced by the energy intensive industrial consumer of
electric power, or other variables or factors which may be relevant
to or affect the continuing vitality of the energy intensive
industrial consumer of electric power in dynamic markets. In
setting a special rate by reference to fluctuations in market
prices for the goods and products produced by an energy intensive
industrial consumer of electric power, the commission may establish
variable rates including, but not limited to, ceilings and floors
on the special rate, banking or crediting mechanisms, caps, limits
or other similar types of safeguards that are intended by the commission, in its reasonable judgment, to provide appropriate
flexibility and predictability in the special rate over time, to
permit the energy intensive industrial customer the ability to make
the capital investments and other commitments necessary to support
the continued operation of the facility.;

On page nine, section one-j, after line one hundred twenty-
nine, by adding a new subsection, designated subsection (f), to
read as follows:
(f) The Commission shall determine whether any excess revenue
or revenue shortfall created by a special rate authorized pursuant
to this section should be allocated among any other customers of
the utility. In making that determination, the Commission shall
consider all relevant factors, including whether such allocation is
just, reasonable, and fairly balances the interests of other
customers, the utility, and the customer receiving the special
rate.

prohibition against certain convicted felons serving as volunteer
firefighters.

as to the effective date and passage of the bill.

to offer an amendment to the bill on third reading.

On page three, section fifteen, line twenty-eight, after the
word "felon" by inserting the words "or in case of a volunteer firefighter, a disqualified felon".
The bill, as just amended, was again ordered to engrossment.

issuing bonds.

on Finance)--A Bill to amend and reenact §11-8-6e, §11-8-10, §11-8-
12 and §11-8-14 of the Code of West Virginia, 1931, as amended, all
relating to the clarification in the code that a municipality or
county issuing bonds approved by an election pursuant to article
one, chapter thirteen of said code is not subject to the restriction described in subsection (c), section six-e, article
eight, chapter eleven of said code; and clarifying that a county,
municipality and board of education shall take into account any
credit payment coming from the United States when calculating the
levy rate.

subpoenas in suspected cases of child pornography and soliciting
minors; limiting authority to certain specific types of offenses;
requiring disclosure by providers of internet service of certain
subscriber information; providing for judicial review and
